The Planning Board will hold a Public Hearing on February 2, 2022, at 7:00 pm at the Lovell Town Hall 1133 Main St. Lovell, Maine to present a proposed amendment to Article 6.2 District Regulations.

The last paragraph of Section 6.2 of the Town of Lovell Zoning Ordinance reads as follows:

“For uses which are not listed in the above table, the Planning Board shall determine which listed use the proposed use is most similar to and the proposed use shall be categorized as that use.”

The Lovell Planning Board proposes this amendment and article to read as follows:

2022 AMENDMENTS

TO THE LOVELL ZONING ORDINANCE

REGARDING USES NOT LISTED ON THE TABLE OF LAND USES

 

The last paragraph of Section 6.2 of the Lovell Zoning Ordinance which follows the Table of Land Uses therein and which now reads “For uses which are not listed in the above table, the Planning Board shall determine which listed use the proposed use is most similar to and the proposed use shall be categorized as that use.” is repealed and replaced with the following:

Subject to the provisions herein governing lawfully existing nonconforming uses, any use not expressly listed in the above table as a permitted use (Y or P), conditional use (C), special exception use (SE), or permit required from Maine Bureau of Forestry use (BFP) shall be considered prohibited in that zoning district.  When there is a question about whether a proposed use is listed in the above table, the Code Enforcement Officer shall make a formal, written determination.

Article xx.        Shall an ordinance entitled “2022 Amendments to the Lovell Zoning Ordinance Regarding Uses Not Listed on the Table of Land Uses” be enacted?
